Use of the Equipment and/or participation in the Services offered by Sukore Wellness + Recovery involves substantial risks to participants. These risks include personal injury or illness ranging from minor to catastrophic, including (without limitation) pain, headaches, irritation, bleeding, fainting, infection, anxiety, virus, disease, low blood pressure, high blood pressure, breathing difficulties, dehydration, dizziness, muscle tears, strains, musculoskeletal injuries, sprains, fractures, broken bones, seizures, heart attacks, strokes, aneurysms, drowning, permanent disability, death, as well as other physical or mental incapacity.

By signing this form and using the Equipment and/or participating in the Services, you indicate that you understand the risks of participation and voluntarily accept these risks. You further release Sukore Wellness + Recovery from all liability associated with your participation.

If you have any of the following medical conditions, you must not use the Equipment or participate in any of the Services. Medical conditions that prevent you from participating include (without limitation):

• Heart conditions or cardiovascular disease (angina, heart attack, aortic stenosis)

• Unstable blood pressure

• Epilepsy

• Infectious disease

• Pregnancy

Assumption of Risk and Waiver of Liability Agreement

In consideration for Sukore Wellness + Recovery allowing me to use the Equipment and/or participate in the Services, I, the undersigned, acknowledge and agree that:

Definitions

In this agreement:

• Equipment means any equipment owned, operated, or utilised by Sukore Wellness + Recovery, which may include (without limitation) traditional saunas, steam rooms, red light therapy machines, cold pools, hot pools, compression boots, hyperbaric oxygen chambers, hyperice guns and recovery tools, or other equipment.

• Services means any service offered by Sukore Wellness + Recovery which may utilise any equipment.

• Sukore Wellness + Recovery means Sukore Wellness + Recovery and any “associated entity” or “related entity” of Sukore Wellness + Recovery as those terms are understood under Sections 9 and 50AAA of the Corporations Act 2001 (Cth).

Acknowledgement of Risks

1. I am aware that the use of the Equipment and/or participation in the Services will include exposure to extreme and suddenly changing conditions, environments, equipment, facilities, and surroundings. This may include (without limitation) cold temperatures, hot temperatures, confined spaces, wet areas and pools, infrared waves, changes in oxygen levels, the application of pressure to my body, and/or restrictions on my normal movement.

2. I have read and understand the Risk Warning above and am aware of the dangers, risks, and hazards associated with my use of the Equipment and/or participation in the Services. These risks include any manner of personal injury or illness ranging from minor to catastrophic including (without limitation) pain, headaches, irritation, bleeding, fainting, infection, anxiety, virus, disease, low blood pressure, high blood pressure, breathing difficulties, dehydration, dizziness, muscle tears, strains, musculoskeletal injuries, sprains, fractures, broken bones, seizures, heart attacks, strokes, aneurysms, drowning, permanent disability, death, as well as other physical or mental incapacity.

3. I acknowledge that the use of the Equipment and/or participation in the Services is being undertaken for the purposes of recreation, enjoyment, or leisure, and involves a significant degree of risk of physical and mental harm as well as the materialization of obvious risks.

4. I acknowledge that the use of the Equipment and/or participation in the Services may be undertaken with one or more other persons as part of a group and that Sukore Wellness + Recovery is not liable for the actions of any other participants or third parties.

5. I am freely and voluntarily assuming any and all dangers, risks, and hazards associated with my use of the Equipment and/or participation in the Services and further acknowledge that I agree to do so entirely at my own risk.

Participants' Health, Fitness, and Physical Abilities

6. Sukore Wellness + Recovery has not made, nor will make, any assessment of my level of health, fitness, or personal abilities to participate in the Services. I am solely responsible for ensuring that I have an appropriate level of health, fitness, physical skills, and personal ability to use the Equipment and/or participate in the Services.

7. I am aware that Sukore Wellness + Recovery strongly recommends that any person who has any medical condition or pregnancy or other impairment or condition whatsoever which may affect the person’s capacity to safely use the Equipment and/or participate in the Services refrain from using the Equipment and/or participating in the Services.

8. I am aware that Sukore Wellness + Recovery strongly recommends that all persons consult a suitably qualified medical professional prior to using the Equipment and/or participating in the Services.

9. I confirm that I have no medical conditions or impairments (physical, mental, or otherwise) which may affect the safety of myself or others using the Equipment and/or participating in the Services.

10. In the event that I am in difficulty during my use of the Equipment and/or participation in the Services, I will immediately stop my use of the Equipment and/or participation in the Services and seek help, assistance, and advice.

Compliance with Directions and Rules

I acknowledge and agree that I must comply with all lawful and reasonable directions of Sukore Wellness + Recovery whether oral or written (including, without limitation, any directions and rules identified on signs).

Waiver of Claim

I will not hold Sukore Wellness + Recovery liable for any loss (including financial loss), damage, personal injury (including physical and mental injury or incapacity), death, or property damage, however caused, arising from or in connection with my use of the Equipment and/or participation in the Services.

Indemnity

To the maximum extent permitted by law, I hereby release and indemnify Sukore Wellness + Recovery from any and all liability, costs (including, without limitation, legal costs), claims, damages, demands, and actions arising out of any incident that is in any way connected with my use of the Equipment and/or participation in the Services, including (without limitation) any such claim, damage, demand, or action that may be brought by me, my dependants, heirs, executors, or administrators, except such incidents caused by the unlawful or grossly negligent acts of Sukore Wellness + Recovery.

Release

I understand that by signing this agreement I will be forever precluded from suing or otherwise claiming against Sukore Wellness + Recovery for any loss, damage, personal injury (including physical and mental injury or incapacity), death, or property damage that I may sustain through my use of the Equipment or participation in the Services.

Entire Agreement and Severability

In entering into this agreement, I am not relying upon any oral or written representations or statements made by Sukore Wellness + Recovery about the risks associated with the use of the Equipment and/or participation in the Services other than what is set forth in this agreement.

If any provision of this agreement is held to be invalid or unenforceable, the remainder of this agreement will not be affected, and it will in other respects continue to be effective and enforceable. If such invalidity or unenforceability is subsequently resolved or changed so it is no longer in conflict with the law, the provision will return to full force and effect.

Successors and Assigns

This agreement will be for the benefit of and be binding on myself and Sukore Wellness + Recovery and their respective successors and permitted assigns.

ACCEPTANCE

By signing below, I:

• Confirm that I have read and understood this document.

• Acknowledge the risks of my use of and/or participation in and/or reliance on the recreational services.

• Accept the terms of this document and agree to be bound by this document.

• Agree that this document will be binding on my heirs, executors, assigns, and next of kin.

I further acknowledge and agree that nothing in this document is intended to limit or otherwise modify the obligations and rights set out in my Sukore Wellness + Recovery visit or membership terms and conditions and any waivers or releases I have signed in relation to my attendance and use of Sukore Wellness + Recovery.

Note: If under 18 years of age, membership and/or attendance is permitted with the consent and signature of a parent or legal guardian below.

Bookings, Refunds, Rescheduling, and Cancellations

At Sukore, we understand that unforeseen circumstances may occasionally disrupt your plans, making it impossible for you to keep your scheduled appointment. To ensure the smooth operation of our services and respect for everyone’s time, we have established the following guidelines:

Bookings:

To schedule or cancel your appointments, please use our online booking system or app.
‍

Refunds:

We do not offer refunds on Memberships, Keep it Casual Bookings, Appointments, Packages, or Gift Cards. This policy helps us maintain a high-quality service by ensuring that our resources are allocated efficiently. We appreciate your understanding and encourage you to consider your
purchase carefully.

Rescheduling:

We kindly request that you cancel or change your sessions at least 5 hours before your scheduled appointment time if you need to reschedule. This advance notice allows us to accommodate your request effectively.
‍

Cancellations:

• You can book and cancel classes any time without a penalty or fee. However, repeated no-shows may result in a fee to maintain fair access for everyone. Cancellations are free up to 5 hours before your appointment. After that, a late cancellation fee of $5 will apply, and a no-show will incur a $10 fee.  

• Your appointment time is specially reserved for you, and late cancellations create gaps in our schedule that could have been filled by others.  

Important: General Health and Wellbeing
Remember, Sukore is about finding what is best for you & what works for your body. A Sukore team member will always be around to help, but ultimately you know your body best. Please always listen to your body & don't let your ego get in the way when putting your body in extreme hot/cold environments.

Medical Conditions and Service Contraindications

You agree to obtain clearance from a medical physician prior to using Sukore’s services if any of the contraindications listed below are applicable to you or if you suspect they may be applicable to you. If any of the contraindications listed below are applicable, you will provide a copy of the medical clearance to Sukore staff prior to commencing a session.

HOT THERAPY: STEAM, HOT POOL + TRADITIONAL SAUNA CONTRAINDICATIONS

Absolute Contraindications:

• Decompensation of chronic diseases of any body systems

• Acute diseases of infectious and other nature

• Pronounced atherosclerosis of vessels with damage to various systems and organs

• Active tuberculosis

• Infectious skin diseases

• Malignant neoplasms

• Tendency to experience bleeding, thrombosis, embolisms

• Severe metabolic disorders such as diabetes mellitus, cachexia (wasting syndrome), hyperthyroidism

• Severe glaucoma

• Psychosis and psychopathy

Relative Contraindications:

• Pregnancy

• Recent alcohol consumption

• Fever, cold, flu symptoms

• Asthma

• Low blood pressure (hypotension)

• Unstable angina pectoris

• Severe aortic stenosis

• Severe orthostatic hypotension

• Multiple Sclerosis

• Central Nervous System Tumours

• Diabetic neuropathy

• Recent myocardial infarction (heart attack)

• Anyone suffering from dehydration, weakness, trauma, or difficulty breathing

ICE BATH/COLD POOLS CONTRAINDICATIONS

Absolute Contraindications:

• Raynaud disease

• Peripheral vascular disease

• Impaired sensation

• Severe cold-induced urticaria

• Cryoglobulinemia

• Paroxysmal cold hemoglobinuria

Relative Contraindications:

• Pregnancy

• Recent alcohol consumption

• Fever, cold, flu symptoms

• Angina pectoris or other severe cardiac disease

• Previous history of cold-induced injury (frostbite, non-freezing cold injuries, immersion foot, and hypothermia)

In exchange for membership access to Sukore Wellness + Recovery, you agree to be bound by the following conditions.
‍

Parties. This Agreement is made between Sukore Wellness + Recovery, operating out of New South Wales (“Sukore Wellness + Recovery”, “we”, “our”, and “us”) and you, the undersigned (electronically) or person who has clicked “I Agree” to this Agreement (“you” and “your”).

‍

Services. We promise to provide you with access to our facility and the full use of our amenities, as well as access to our regularly scheduled classes at Sukore Wellness + Recovery (the “Membership”) according to the terms outlined in Schedule “A” Memberships below.
‍

Term. This Agreement will be binding upon your Membership payment and will last for the time specified in Schedule “A” Memberships below or as specified online or as agreed upon between us (the “Term”). You can decide to renew the Term of this Agreement as many times as you would like.
‍

Membership Cancellation. To cancel your Membership, please inform Sukore Wellness + Recovery 7 days prior to the desired termination date by sending us an email to members@sukore.com.au with your full name, membership type, and reason for cancellation. If a cancellation request is due to injury, relocation, or other circumstances, Sukore Wellness + Recovery reserves the right to request supporting documentation.

Membership Freeze. To place your membership on Freeze, you can email us at members@sukore.com.au and request the freeze to be processed. You must provide a start and end date for the freeze time. Membership freezes will be decided upon on a case-by-case basis; however, in most cases, a maximum duration of 4 weeks is allowed.
‍

No Show Fee. You can book and cancel classes any time without a penalty or fee. However, repeated no-shows will be charged a $5 late cancellation fee if they do not cancel their booking within the specified 5-hour notice period. If a member does not show up for their appointment, a $10 no-show fee will be charged.
‍

Our Commitment to You. Through your Membership, Sukore Wellness + Recovery is committed to providing you with the best wellness and recovery techniques tailored for those looking to reduce soreness, increase mental clarity, enhance sleep, and improve overall quality of life.
‍

Scheduling. Please consult Sukore Wellness + Recovery or refer to our available schedule of classes for the exact scheduling and timing of our classes. All bookings must be made online to ensure your spot is available to you.
‍

Payment. You agree to pay the price, including the possibility of incremental payments (“Incremental Payment”), of the Membership as outlined below in Schedule “A” (the “Payment”). All Payments, prices, and costs are in AUD. The Payment price outlined in Schedule “A” is subject to taxes and additional fees. Any subsequent changes to the Payment price will not affect the validity of this Agreement. Payment is due upon completed purchase of the Membership and must be made in full prior to the start of your Membership. For all memberships, you must make payment to Sukore Wellness + Recovery, the agreed amount as per your membership agreement in advance by way of direct debit.

Incremental Payments. If your method of Payment includes Incremental Payments, you authorize Sukore Wellness + Recovery to maintain your account information and charge that account automatically upon the renewal of the Membership with no further action required by you. Sukore Wellness + Recovery will charge your method of payment as outlined in Schedule “A” for the Incremental Payment. We will not notify you before the Payment charge.

Refunds. Our refund policy is as follows: All sales are final. Memberships are non-refundable and non-transferable.
‍

Legal Fees. You will be responsible for any and all legal fees incurred by Sukore Wellness + Recovery regarding any potential chargeback issues (for example, if you want to issue a chargeback or contest a payment).
‍

Payment Failure. In the event that your payment fails, your Membership access will be temporarily suspended until we receive your Payment. In the event of three failed payments, you understand that Sukore Wellness + Recovery may contract a collection agency to collect the money from you.
‍

No Guarantees. Sukore Wellness + Recovery cannot guarantee any particular success from participating in our classes or from our Membership. We promise to provide you with the opportunity, services, and protocols support to achieve your goals, but any success and results ultimately depend on your commitment.
‍

Code of Conduct. You agree to be mindful and respectful during the services and duration of your Membership. This includes respecting other members of Sukore Wellness + Recovery in their wellness journey and taking care when using the facilities. You also agree to comply with our facility protocol, policies, and guidelines, as updated from time to time on our website or posted on-site.
‍

Facility Closure. If our facility is forced to close due to COVID-19, a natural disaster, or other unavoidable circumstances, the Membership freezes until the facility can reopen.
‍

Force Majeure. Sukore Wellness + Recovery will not be liable for any failure or delay regarding the Membership if such failure or delay is beyond the reasonable control of Sukore Wellness + Recovery, could not have been reasonably foreseen or provided against, or due to events such as a pandemic, natural disaster, or other Act of God. In such an event, you will not be entitled to any refunds or recovery.

Substitute Services. Sukore Wellness + Recovery has the right to substitute services. This means that if we ever need to switch to online classes or asynchronous virtual offerings due to circumstances beyond our control, we have the right to such a substitution for in-person classes.
‍

Waiver. Before your Membership can begin, you must sign our Waiver Agreement form. Please read it and make sure you understand it. You need to sign that form as well as this Agreement so that we can be absolutely sure you understand and agree to it.
‍

COVID-19 / Infectious Disease. Amidst the current developments surrounding communicable diseases, you acknowledge that every time you participate in any of the Membership activities you are affirming that you are healthy and that you do not present an increased risk due to COVID-19 or other infectious diseases. If you are suffering from symptoms of a communicable disease or are unsure of your health and ability to partake in the Membership activities, please consult with your doctor, and we urge you not to visit our facilities. You further agree to follow the relevant guidelines and comply with our policies around COVID-19, including the use of masks or other protective gear, social distancing, and hygiene practices. We are all in this together and need to remember to act responsibly and with kindness towards each other to ensure everyone’s safety.

Media Release. We think you’re incredible and would love to show you off! By being a member at our facility and through your Membership, you agree to grant us the irrevocable right to use your image, likeness, photographs, video content, and audio recordings of you captured in our facility or that you share with us online (via your own or others posting of you) as part of our online streaming, marketing, and sales throughout the world and in perpetuity. You also release us from all claims you may have relating to the use mentioned in this section. Please let us know if you ever want us to stop using an image of you.

Indemnity. You hereby fully indemnify Sukore Wellness + Recovery and any of its members, directors, officers, employees, contractors, volunteers, agents, executors, administrators, successors, family members, and assigns (the “Released Parties”) from any liability and damages arising from death or personal injuries. This includes the contraction of COVID-19 or other communicable diseases or related to premises liability, however caused, including as a result of Sukore Wellness + Recovery’s negligence, provided that where Sukore Wellness + Recovery has contributed to such liability by its own negligent conduct, your indemnity obligation will be limited proportionately.

Standard Legal Things.
‍Choice of Laws and Venue. This Agreement will be governed exclusively by the laws of New South Wales. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of New South Wales
Severability. If any provisions of this Agreement are invalid or unenforceable, the other provisions in the Agreement will remain in full force and effect.
‍Entire Agreement. This Agreement constitutes the entire Agreement between the parties and replaces any prior agreements.
‍Waiver of Breach. The waiver by Sukore Wellness + Recovery of any breach by you of any provision of this Agreement will not be taken to be a waiver of any further breaches by you.
‍Notice. For the purpose of this Agreement, e-mail or text will suffice for written notice when required as set out above.
‍Headings. The headings used in this Agreement are for stylistic purposes only, and none of the content in the headings are intended to be legally binding.
‍Counterparts. This Agreement may be signed by any number of counterparts, each of which is an original, and all of which taken together constitute one single document.
‍Online Agreement. We agree that this Agreement may be signed electronically or agreed to by having you click “I Agree,” the effect of which will be the same as if we signed the Agreement by hand and the intention of which is that both parties desire to be bound by all the terms of the Agreement.

To assist us in maintaining a safe and comfortable environment for all members and staff, you are required to abide by the following conditions. Failure to abide by these conditions may result in the termination of your session and suspension or termination of your membership.

Community Guidelines

• Age Requirement: You must be 16 years or over to use the facility. Children aged 16 and 17 years are allowed to enter the facility independently only after the liability waiver has been signed by a parent or legal guardian.
  

• Children: For the safety and comfort of our staff and clients, we ask that no children accompany you to your appointment.
  

• Arrival: Please arrive 5 minutes before your scheduled session time. This ensures you have time to change and make the most of your Sukore experience.
  

• Entry: Entry will be refused, or you may be requested to leave the Studio if you are using abusive or threatening language or behaving in a threatening way, or, in the reasonable opinion of Sukore staff, you are under the influence of drugs or alcohol or you behave in another way that is considered by Sukore (acting reasonably) to be risky or seriously inappropriate.

• Behaviour: You should conduct yourself in a manner that will not disturb or impair the use and enjoyment of the Studio by any other person. In particular, you must not use foul, loud, or abusive language, nor will you behave in a threatening manner, nor will you molest, or harass, other members, guests, visitors, or staff.

• ‍Camera Use: Taking photos or videos of other members without their consent is a breach of our terms and conditions. You may be requested to delete them if anyone challenges whether or not they feature another member. If we have concerns with you taking photo or video footage in the Studio, we may ask you to show us the images taken and ask you to delete them if appropriate.
  

• Non-Smoking: Smoking is strictly prohibited in the Studio, including the use of electronic cigarettes or similar devices.
  

• Drugs and Alcohol: You may not bring, use, or be under the influence of drugs or intoxicating liquor or substances in any part of the Studio.
  

• Food and Water: We recommend having something to eat before your session, especially in the early mornings. We also recommend drinking plenty of water before, during, and after your session.
  

• Clothing: All members and guests must be dressed in suitable attire at all times while in the Studio. Appropriate swim attire must be worn in the saunas and pools. For dry services, we recommend wearing loose, comfortable clothing or exercise attire.
  

• Showering: You are required to shower before and after your session if using the saunas and/or pools. Avoid the use of body creams, oils, and fake tan in all service areas.
  

• Towel Use: You are required to bring a clean towel to your session, dry off before entering the saunas, and sit on a towel while using the saunas. Towels can be hired from reception and must be returned to reception upon exit.  

• Lockers: All personal belongings are required to be stored in the lockers provided. Sukore does not undertake that use of a locker will guarantee that no theft of or damage to your property will occur. We will not accept any liability in respect of any damage to or loss of property which is left by you in or about any locker.

We appreciate your understanding and cooperation with these policies. These guidelines are in place to ensure the availability of our services to all our valued clients.
